For California Residents Only

Under California Civil Code Section 1798.83, you may request information from us about the type of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. These requests may be made once a year and are free of charge. If you would like to make such a request, please submit your request to us in writing using the contact information provided below.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

Consent

We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.

Performance of a Contract  We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.

Legitimate Interest

We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:

  • Send users information about special offers and discounts on our products and services
  • Develop and display personalized and relevant advertising content for our users
  • Analyze how our Services are used so we can improve them to engage and retain users
  • Support our marketing activities
  • Diagnose problems and/or prevent fraudulent activities
  • Understand how our users use our products and services so we can improve user experience
  • Enforce our policies for business purposes, legal requirements, and contractual requirements
  • Respond to legal requests

Legal Obligations

We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.

Vital Interests

We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

In legal terms, we are generally the “data controller” under European data protection laws of the personal information described in this Privacy Notice, since we determine the means and/or purposes of the data processing we perform. This Privacy Notice does not apply to the personal information we process as a “data processor” on behalf of our customers. In those situations, the customer that we provide services to and with whom we have entered into a data processing agreement is the “data controller” responsible for your personal information, and we merely process your information on their behalf in accordance with your instructions. If you want to know more about our customers’ privacy practices, you should read their privacy policies and direct any questions you have to them.

GDPR Legislation

Under GDPR legislation you have a number of rights about how your data is processed.  The lawful basis for our processing can also affect which rights are available to individuals.  Full details of your personal rights can be found on the Information Commissioner’s Office website.

Your rights include;

  • Right to be informed – this encompasses our obligation to provide ‘fair processing information’ on how we use your data through a privacy statement;
  • Right of access – individuals have the right to access their personal data (Subject Access Request);
  • Right to rectification – individuals have the right to have their personal data rectified to ensure it’s accurate and complete;
  • Right to erasure (or right to be forgotten) – individuals have the right to request the deletion or removal of their personal data where there is no compelling reason for its continued processing (except where we are required to hold the data by law and where there is legitimate interest to withhold it);
  • Right to data portability – individuals have the right to obtain and reuse their personal data for their own purposes across different services;
  • Right to object – individuals have the right to object to processing their personal data in certain circumstances;

If a third-party service provider is processing your EU or UK users’ personal information, they need to provide you with a data processing agreement in order for you to comply with the GDPR. This agreement can usually be found in the third-party service provider’s terms of service, or they may have a separate data processing agreement. Ask your third-party service providers for their data processing agreements if you’re unable to locate them. If you do not have the third-party service provider’s data processing agreements, then it will be in violation of the GDPR. This step is crucial for GDPR and UK state privacy law compliance and we suggest that you contact your third-party service providers and ask them to sign a Data Processing Agreement with you.
